Big State AI User Agreement

Thanks for using Big State AI ("BSA") — an AI-powered tool that drafts and analyzes construction project schedules. This agreement is written in plain English. It covers your use of the application at app.bigstate.ai and is between you and Big State Solutions, LLC, a Texas limited liability company doing business as Big State AI ("we," "us").

1. The Service is provided as-is

BSA is actively developed. Features may change or be withdrawn without notice, and access may be interrupted at any time. THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

2. BSA output is an AI-generated FIRST DRAFT — never a certified deliverable

Every schedule, narrative, report, and export BSA produces is generated with the assistance of AI and calculated by automated tools. It is a starting point that must be reviewed, corrected, and approved by a qualified scheduler (and, where required, a licensed professional) before any use that matters. Do not submit, certify, baseline, or rely on a BSA output as-is — not for contractual submission, claims, payment, design, or construction decisions. BSA does not provide engineering, legal, accounting, or other licensed professional advice, and using it does not create a professional-client relationship. You are solely responsible for verifying every output against your project's scope, contract, site conditions, and applicable codes.

4. Your feedback becomes ours to use

Bug reports, ideas, suggestions, and survey responses you give us about BSA may be used freely by us — to fix, improve, and build the product — without payment or attribution, forever. (Your project content is NOT feedback; §3 governs that.)

5. Billing is live — real charges, and how asking for credits back works

Billing is on. Buying a credit pack is a real payment through Stripe, and the credits land in your balance once it clears. AI actions spend credits at the rates shown in the app at the time of the action; the deterministic work — edits, exports, template outputs — costs nothing.

You are only charged for work that succeeds. Credits come out of your balance on success only. If a run errors out and doesn't give you the deliverable, it costs you nothing.

Asking for credits back. Purchased credits are non-refundable as a rule (Refund Policy §3.1). If a specific run let you down, ask for that run's credits back from inside the app: we attach the run's own record to your request, a person here reviews it individually under §3.2, and we decide. Approved requests come back as credits to your balance — that path returns credits, not cash — and nothing is automatic: a request is a request, not a guarantee. If you think you were charged in error, that is §3.3 — email ai@bigstate.ai within 30 days and we'll investigate and correct verified errors. We may also grant you free ("comp") credits; those have no cash value.

6. Unreleased features and pricing stay between us

Please don't publicly post screenshots, feature details, pricing, or performance claims about features we have not released publicly without asking first — we're happy to say yes to most things, but unreleased features and pricing change fast and stale screenshots outlive products. This ends for any feature once we say it is public.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIG STATE SOLUTIONS, LLC AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DELAY, DISRUPTION, OR SCHEDULE/PROJECT IMPACT, ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE OR ITS OUTPUTS. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THIS AGREEMENT WILL NOT EXCEED THE AMOUNT YOU PAID TO BSA IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

8. We can end access anytime

We may suspend or terminate your access at any time, for any reason, without notice — and you can walk away anytime. On request at exit, we'll handle your data per §3. If we end your access and you still hold purchased credits, email ai@bigstate.ai — we'll review them under §5 and the Refund Policy.

9. Boring but necessary

This agreement is governed by Texas law; venue is the state or federal courts in Texas. It's the whole deal between us about your use of BSA, alongside the published Terms, Privacy Policy, and AI-Output & Professional Notice at bigstate.ai. We may update this agreement; we'll send you the new version and ask you to accept it again before it applies to you.


Acceptance

Big State AI User Agreement v1.0 (2026-08-26). By clicking Accept where this agreement is presented in the application, you agree to these terms. Your acceptance is recorded automatically — per user, with the legal version and a timestamp. (Acceptances given by email reply or a signed copy before the in-app click-wrap are logged in our acceptance register.)
